These Terms of Service ("Terms") govern your access to and use of the website and related online services made available by ICTC, LLC dba Inner Child Theater Camp ("ICTC," "we," "us," or "our"), including www.innerchildtheatercamp.com and any related webpages, forms, or online features that link to these Terms (collectively, the "Site").

By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

ELIGIBILITY

The Site is intended for individuals who are at least 18 years old. By using the Site, you represent that you are at least 18 years old and legally able to agree to these Terms.

PURPOSE OF THE SITE

The Site is provided to share information about ICTC and its camps, events, workshops, and related offerings. The Site may allow you to learn about offerings, submit inquiries, join a mailing list, complete forms, request information, and register or apply for events or programs.

Use of the Site does not create any medical, mental health, therapeutic, fiduciary, or professional advisory relationship with ICTC.

SEPARATE EVENT TERMS

These Terms apply to use of the Site only.

If you register for or participate in an ICTC camp, retreat, workshop, class, or other offering, you may also be required to agree to separate terms, policies, waivers, releases, media consents, payment terms, or event-specific rules. If there is a conflict between these Terms and a separate written agreement for a specific offering, the separate written agreement will control for that offering.

PRIVACY

Your use of the Site is also subject to our Privacy Policy.

INFORMATION YOU SUBMIT

If you submit information through the Site, you agree that it will be true, accurate, current, and complete. You may not impersonate another person, misrepresent your identity or affiliation, or submit false or misleading information.

We may reject submissions, limit access, or cancel registrations if information provided is inaccurate, incomplete, misleading, unlawful, or inconsistent with these Terms.

REGISTRATIONS, PAYMENTS, AND THIRD-PARTY SERVICES

Prices, dates, instructors, venues, schedules, and program details may change.

ICTC may use third-party providers for forms, registration, payment processing, email communications, or related services. Your use of those third-party services may also be subject to their own terms and privacy policies.

Unless otherwise stated in separate offering-specific terms, all fees are in U.S. dollars and payment is due as stated at the time of purchase or registration. Refunds, transfers, credits, and cancellation rights, if any, are governed by the specific terms applicable to the offering you register for.

ICTC may correct pricing or description errors, reject or cancel registrations, and refuse transactions arising from error, suspected fraud, misuse, or violation of these Terms.

ELECTRONIC COMMUNICATIONS

By providing your email address or phone number, you agree that ICTC may contact you electronically, including by email and, where applicable, by text message, for transactional or service-related communications. You may unsubscribe from marketing emails using the unsubscribe link in those messages.

INTELLECTUAL PROPERTY

The Site and its content, including text, graphics, logos, branding, images, videos, forms, and other materials, are owned by ICTC or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, ICTC grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use only.

You may not, without ICTC's prior written consent:

copy, reproduce, republish, or distribute Site content except as expressly permitted;
modify, adapt, reverse engineer, scrape, frame, or create derivative works from the Site or its content;
use ICTC's name, logos, or branding; or
use Site content for commercial purposes.

USER SUBMISSIONS

If you submit comments, testimonials, suggestions, photos, videos, recordings, or other materials to ICTC through the Site or otherwise, you represent that you have the right to do so and that your submission does not violate any law or third-party rights.

Unless ICTC agrees otherwise in writing, you grant ICTC a non-exclusive, royalty-free license to use, reproduce, display, and distribute your submission for lawful business, promotional, editorial, or archival purposes, subject to our Privacy Policy and any separate written release or agreement that may apply.

ACCEPTABLE USE

You agree not to use the Site to:

violate any law or third-party right;
infringe intellectual property, privacy, or publicity rights;
harass, threaten, abuse, defame, or harm another person;
upload malware or other harmful code;
interfere with the operation or security of the Site;
attempt to gain unauthorized access to systems or data;
collect information from the Site through unauthorized automated means; or
impersonate ICTC or any other person or entity.

We may suspend, restrict, or terminate access to the Site if we believe these Terms or applicable law have been violated.

NO MEDICAL OR THERAPEUTIC ADVICE

The Site may reference creativity, confidence, connection, self-expression, or personal growth. Such content is for general informational purposes only.

ICTC does not provide medical care, psychotherapy, mental health treatment, or other licensed healthcare services through the Site. Nothing on the Site is intended to diagnose, treat, cure, or prevent any condition or to substitute for professional advice from a qualified provider.

NO GUARANTEE OF OUTCOMES

ICTC does not guarantee any particular result, experience, personal outcome, artistic outcome, or other outcome from using the Site or participating in any ICTC offering.

THIRD-PARTY LINKS

The Site may contain links to third-party websites or services. ICTC is not responsible for their content, availability, or practices. Your use of third-party services is at your own risk.

COPYRIGHT COMPLAINTS

If you believe that any content on the Site infringes your copyright, you may send us a written notice at i[email protected] with the subject line "Copyright Notice."

Your notice should include:

your name and contact information;
a description of the copyrighted work you claim has been infringed;
the specific URL or location of the material you believe is infringing;

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

ICTC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ICTC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICTC AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICTC'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) $100, OR (B) THE AMOUNT YOU PAID DIRECTLY TO ICTC THROUGH THE SITE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

SOME LAWS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY.

INDEMNIFICATION

You agree to indemnify and hold harmless ICTC and its owners, members, managers, employees, contractors, agents, affiliates, and licensors from claims, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

your misuse of the Site;
your violation of these Terms;
your violation of any law or third-party right; or
information or materials you submit to ICTC.

GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

DISPUTES

Before filing a legal claim relating to the Site or these Terms, you agree to first contact ICTC at [email protected] and attempt in good faith to resolve the dispute informally.

If a dispute cannot be resolved informally, any lawsuit relating to the Site or these Terms must be filed in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of those courts.

TERMINATION

ICTC may suspend or terminate access to the Site if it reasonably believes you have violated these Terms or applicable law.

Any provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute provisions.

CHANGES TO THESE TERMS

ICTC may update these Terms from time to time. When we do, we will post the updated version on the Site and revise the Last Updated date above. Your continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms, to the extent permitted by law.

SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

ENTIRE AGREEMENT

These Terms, together with any policies incorporated by reference and any separate written terms applicable to a specific offering, form the entire agreement between you and ICTC regarding your use of the Site.
